These Terms of Service ("Terms") govern your access to and use of the website and services provided by Meld ("we", "us", or "our"), operated from Tampa, FL. By accessing or using our services, you agree to be bound by these Terms.

Acceptance of Terms

By accessing our website, creating an account, or engaging our services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use our services.

We reserve the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance of the revised Terms.

Our Services

Meld provides AI-native digital services including but not limited to:

  • Custom software development (MVPs, web and mobile applications)
  • Digital marketing (paid media, SEO, CRO, content)
  • SaaS product development and licensing
  • Bilingual digital services (English/Portuguese)

The specific scope, deliverables, timeline, and pricing for each engagement are defined in a separate Statement of Work (SOW) or project agreement signed by both parties.

User Accounts

Some features require creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

Payments and Billing

Payment terms are specified in your project agreement or subscription plan. All fees are in US dollars unless otherwise stated.

  • Project engagements typically require a deposit before work begins
  • Subscription services are billed in advance on a recurring basis
  • Late payments may incur a 1.5% monthly interest charge
  • All payments are processed securely through Stripe

Refunds

Deposits for project work are non-refundable once work has commenced. For subscription services, you may cancel at any time, but no refunds are provided for the current billing period. Disputes should be raised within 30 days of the charge.

Intellectual Property

Upon full payment, you own all custom code, designs, and deliverables created specifically for your project. We retain ownership of our pre-existing tools, frameworks, and proprietary methodologies used during development.

We reserve the right to showcase the work in our portfolio unless otherwise agreed in writing. You grant us a non-exclusive license to use your company name and logo for this purpose.

You retain full ownership of any content, data, or materials you provide to us during the engagement.

Acceptable Use

You agree not to use our services to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit malicious code, spam, or harmful content
  • Attempt to gain unauthorized access to our systems

Limitation of Liability

To the maximum extent permitted by law, Meld shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Our total liability for any claim shall not exceed the amount paid by you to Meld in the twelve (12) months preceding the claim.

Warranty Disclaimer

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Termination

Either party may terminate a project engagement as outlined in the applicable SOW. For subscription services, you may cancel at any time through your account settings.

We may suspend or terminate your access immediately if you breach these Terms. Upon termination, we will provide your data and deliverables as outlined in our data retention practices.

Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Hillsborough County, Florida.
